  1. This Lease constitutes an agreement between the Rector and Visitors of the University of Virginia ("University") as Lessor, and the undersigned (full-time student, faculty/staff member, or eligible resident) as Lessee, for the rental of University property as a residence (the "Leased Premises") as long as the eligibility requirements and Terms and Conditions of this Lease are met.

  2. This Lease allows Lessee, family members, and invited guests to use the Leased Premises. In addition, only Lessee, family members and guests may use common areas, including hallways, lounges, etc., in accordance with University rules and regulations governing such areas. The University maintains residential property to further its academic mission. Other uses must be secondary to that purpose.

  3. General Provisions: The University reserves the right at any time to:

    1. Unilaterally increase or decrease the rent or to make any other changes in this Lease deemed necessary. Such changes shall be effective no less than sixty (60) days after Lessee is given written notice of the proposed changes.

    2. Enter the Leased Premises during reasonable hours for routine maintenance, inspections, repairs, or housekeeping duties after providing oral or written notification of the date of entry; enter the Leased Premises at any time for an emergency.

    3. Control the Leased Premises and any common areas in the event of an emergency.

    4. Assign graduate and undergraduate students to the same Leased Premises.

    5. Terminate or suspend the Lease for violation of these Terms and Conditions or for violation of University Regulations pertaining to health or safety as determined by the University at its sole discretion.

  4. Further Regulations: This Lease is subject to all relevant University policies which, from time to time, may be amended or updated.

  5. Term: This Lease is effective as of March 9, 2013 through May 31, 2014. Maximum length of stay in University properties will be four years in duration, regardless of location with an effective date of February 1, 2013, and to end no later than 5:00 p.m., May 31, 2017. Renewal notices shall be sent electronically to all tenants on March 1 and, if renewal is desired, must be returned electronically to the GFS Housing Rental Agent. Otherwise the unit will be available for rent to a new tenant for the upcoming year.

  6. Eligibility: Lessee must maintain eligibility throughout residency (except during the summer). Eligibility will be periodically verified by the Graduate & Faculty/Staff Housing Office (GFS Housing Office). Eligibility is defined as a full-time student, post-doctoral fellow, medical resident, research assistant/associate, staff or faculty member. A change in family size may deem the resident no longer eligible for GFS Housing or could necessitate relocation to other Leased Premises, if available.

  7. Occupancy Limits: 1 Bedroom: At most two adults (if two adults they must be married), and one child; or one adult and no more than two children. 2 Bedroom: At most four adults (all adults must meet eligibility requirements); two adults (if not married, both adults must meet eligibility requirements) and three children; or one adult and no more than four children. 3 Bedroom: At most six adults (all adults must meet eligibility requirements); two adults (if not married, both adults must meet eligibility requirements) and 4 children; or one eligible adult and no more than five children.

  8. Safety: Lessee is personally responsible for abiding by the safety policies pertaining to the Leased Premises and to residential facilities and other University property, generally. (See the Emergencies, Safety and Health section of the website).

  9. Releases: This Lease is binding for the entire Term.

  10. Assignment and Subletting: The Leased Premises shall not be exchanged, assigned or offered as a sublet.

  11. Commercial Enterprise: Lessee may not conduct any activity for business or financial gain from the Leased Premises or any University Property.

  12. Smoking: Smoking is prohibited in or within 25 feet of the Leased Premises and all on-Grounds housing facilities.

  13. Rent: Lessee agrees to pay the University, in advance on the first of each month. The Lessee's account will be delinquent after the tenth calendar day of the month. In the event that payment has not been made by the eleventh calendar day of the month, the account will be forwarded for collection. Non-payment will result in student records (transcripts, diplomas, etc.) being made inaccessible. No security deposit will be collected from Lessee. Upon termination of this Lease, any charges for cleaning, lost keys, or damages will be billed to Lessee to be paid within thirty (30) days from date of bill.

  14. Furnishings and Facilities: The University shall provide a stove and refrigerator for the Leased Premises. Some, but not all, units also may be provided with a dishwasher. It is understood that the University shall not be responsible for any loss or damage to Lesseeā€™s food or other personal property if the stove or refrigerator should fail to operate properly but shall undertake prompt repairs or replacements as soon as reported to the University. The University will choose and provide furnishings for each furnished facility. The University shall not provide additional storage space. All University-owned furniture must remain in its assigned space. It is prohibited to keep any item, including room decorations that may pose a fire hazard, in a residential facility. Specific information on regulations, policies, prohibited and approved items related to furnishing and facilities are listed in the Fire Safety and Decoration Policies.

  15. Maintenance and Repairs: The University shall perform all normal interior and exterior maintenance and repairs as necessary. Lessee shall report all needs for repairs to the Housing Facilities Zone Office by using the Work Order Management System or by phoning the office at 924-3053. Lessee is not permitted to make repairs.

  16. Damages: Lessee is responsible for any damage or defacement that may occur to the Leased Premises (including restitution costs), except for normal wear and tear. If the University cannot determine responsibility for damage or defacement in common areas (bathrooms, lounges or corridors, etc.), the University will distribute the charge equally to all lessees of the facility. If the Leased Premises are demolished or damaged by fire or other casualty and thereby rendered uninhabitable for a period of more than thirty (30) days, this Lease shall terminate as of the date of such destruction or damage. However, should such damage be repaired by the University within 30 days from the occurrence, this Lease shall not terminate but payment of rent shall be suspended for the period during which the Leased Premises are uninhabitable.

  17. Abandoned Property: Abandoned property collected from the Leased Premises will be held in storage for 120 days from date of removal. After 120 days, property will be disposed of or sold through UVa Surplus Property.

  18. Insurance: The University does not assume any obligation or liability for loss or damage to items of personal property, which may occur in its Leased Premises, other buildings or on its grounds, before, during or after the Term of this Lease. This includes but is not limited to damage, loss, fire, water damage, theft, flooding, etc. Lessee is encouraged to obtain renter's insurance for protection against loss or damage.

  19. Access: Keys and ID cards are property of the University. It is against Virginia law to have duplicate keys made. Lessee will be assessed a charge for each lost key and for each replaced lock core. If Lessee loses a key(s), Lessee will be billed for replacing all affected keys and locks. Lessee must report lost keys promptly to Housing & Residence Life to arrange replacement. Lessee must promptly report a lost ID card to the ID office and will be assessed a charge for its replacement. Keys and ID cards are non-transferable.

  20. Guests: Overnight guests may not remain longer than seven consecutive nights. Written permission from Housing & Residence Life is required for any visit exceeding seven nights. Residents are responsible for the behavior of guests and their compliance with all University policies.

  21. Prohibited Possessions: To ensure the safety of all residents, certain items are prohibited within all on-Grounds residential areas, including the Leased Premises. Lessee is responsible for reviewing and remaining aware of the list of prohibited items.

  22. Personal Wireless Devices: Residents must comply with the University's policy on wireless airspace.

  23. Criminal Conviction or Protective Order: If Lessee or any resident of the Leased Premises is convicted of any felony or any crime requiring registration on the Sex Offender or Crimes Against Minors Registry (SOR), or if Lessee or any resident of the Leased Premises becomes subject to a protective order at any time during the Term of this Lease, Lessee is required within seventy-two (72) hours of the conviction or entry of the protective order, to notify in writing Housing & Residence Life in accordance with the notice provisions. Housing & Residence Life reserves the right to cancel this Lease if, in the sole judgment of the University, Lessee or any resident may pose a threat of substantial harm to persons or to University property or if the University determines that this Lease was granted on the bases of inaccurate or incomplete information.

  24. Sales, Solicitation, and Peddling: Sales, solicitation, and peddling are prohibited within the Leased Premises and all University residential areas.

  25. Conduct: Lessee and all residents of the Leased Premises and other properties managed by the University are subject to all Federal, State, and local laws, as well as the University's academic, financial, and non-academic rules and regulations. The specific University policies and regulations are listed in the University of Virginia Record. This Lease prohibits violations of those laws and regulations.

  26. Additional Provisions: The University retains unilateral right to terminate this Lease for the breach of any Term or Condition of this Lease by Lessee. Failure of either party to insist upon strict performance of any of the Terms or Conditions herein shall not be deemed a waiver of any rights or remedies of either party, and shall not be deemed a waiver of any subsequent breach or default in any of the Terms or Conditions herein. The University does not discriminate in any of its programs, procedures, or practices against any person on the basis of age, citizenship, color, disability, national origin, political affiliation, race, religion, sex, sexual orientation, or status as a veteran. If Lessee has a disability or otherwise needs special accommodations, Lessee must notify Housing & Residence Life.
